Course Catalog Description:: Analysis of court opinions and federal regulations affecting postsecondary educational institutions.
Class Description:: This course is designed for graduate students and law students interested in higher education law. No prior experience with reading legal sources or conducting legal research is required. Nor is a background in studying higher education. What is "required" is an interest in some of the most pressing legal issues that confront colleges and universities today. These include legal and policy issues that arise in the relationships between colleges and students (e.g., discipline, student privacy, and free speech) and colleges and faculty (academic freedom, tenure, etc.). In addition, we will explore intersections between higher education law and policy with a particular emphasis on anti discrimination laws and affirmative action. To gain a better understanding of how the law works (or doesn't work) in higher education, students will perform a mock trial. The final, culminating assignment, allows learners to choose a legal issue of particular interest and create a training manual or write a scholarly literature review.
