Course Catalog Description:
Survey of Roman law from social and historical perspectives. Basic concepts of Roman private law and legal procedure. prereq: Grad student or instr consent
Class Description:
It has been accurately observed that: "Roman law gave to almost the whole of Europe a common stock of legal ideas, a common grammar of legal thought, and, to a varying but considerable extent, a common mass of legal rules." In fact the preponderance of national legal systems operating in the world today are rooted, directly or indirectly, in the law of ancient Rome. This course is intended to serve as an introduction to Roman private law, focusing particularly on the law of property. The initial part of the semester will be spent introducing the textual sources of Roman law and the nature of Roman legal procedure. We will then review the evanescence of Roman law in late antiquity, its "rediscovery" and revival in the middle ages, and its subsequent receptions in the Renaissance, Enlightenment, and modern periods. The second part of the semester will be devoted to more detailed consideration of a single substantive area Roman law, the law of property. This topic will be explored through discussion of "cases" culled from Roman juristic sources. Our casebook includes excerpts from modern European civil codes that illustrate how the Roman rule has been adopted, adapted, or rejected in modern legal regimes. A website that accompanies our casebook will broaden the scope of comparison so as to include the common law tradition as well.
